Regulatory Certainty Depends on Transparency, Model Observability & Explainability
Regulatory certainty is not achieved through data alone. It requires confidence in how that data is used.
The first pillar of regulatory certainty focuses on data completeness: proving that what should be captured is captured. But once that foundation is established, regulatory scrutiny shifts quickly, from inputs to outcomes.
Not just what your systems captured, but what they did with it.
Why was this alert generated? Why was another not? And can those decisions be explained in a way that is clear, consistent and defensible?
This is where many compliance programs begin to feel exposed.
From Rules to Complexity
Over time, surveillance hasn’t just improved. It has fundamentally changed.
What were once straightforward, rule-based systems have evolved into layered environments combining statistical models, behavioral analytics and AI-driven techniques. These systems analyze patterns across vast datasets, surfacing risks that static thresholds would never detect.
But this added sophistication comes at a cost.
Decisions are no longer tied to a single, easily explainable rule. Instead, they emerge from multiple signals, weighted interactions and model-driven logic that isn’t always transparent.
The result is a growing gap between what the system produces and what the organization can explain.
What Regulators Are Really Asking
Regulators are not asking firms to explain every algorithm mathematically. They are asking something more practical, and more demanding.
Are you in control of your models?
That means being able to demonstrate:
- Why an alert was generated, or why it was not
- That each model’s purpose, inputs, thresholds and limitations are clearly defined
- That model changes are governed, documented and auditable
- That performance is continuously monitored (rather than only periodically reviewed)
- That independent oversight exists for surveillance and AI models
These are not theoretical expectations. They are operational requirements.
The Gap Between Governance and Understanding
Most firms have model governance frameworks in place. Models are documented, validated and subject to oversight. But governance alone does not ensure that model behavior is fully understood in practice.
A model can be well-documented and still behave in ways that are difficult to interpret once deployed. Performance can drift over time. Threshold changes can introduce unintended effects. Alert quality can degrade, often gradually and without immediate visibility.
The distinction is critical: governance defines how models are intended to operate, but observability reveals how they actually perform.
This is where model observability becomes essential.
Firms need clear, ongoing visibility into model behavior, including:
- How alert volumes shift over time
- Where false positives and false negatives occur
- How models respond across different scenarios
- How sensitive outcomes are to changes in inputs or thresholds
Without this level of insight, models remain opaque, even within well-governed frameworks.
Embedding Explainability Into the Workflow
Understanding how models behave is only part of the challenge. Firms must also be able to explain those behaviors in the context of real decisions.
This is where explainability moves from theory into practice.
One of the most important developments is the shift to embed explainability directly into the investigation workflow.
Rather than requiring analysts to interpret complex model outputs, systems increasingly provide contextual explanations alongside alerts (highlighting key contributing factors, relevant behaviors and comparable scenarios).
This shift improves both efficiency and defensibility.
Analysts no longer need to reconstruct decision logic manually. Instead, they can work directly with structured, consistent explanations. At the same time, organizations gain greater consistency in how decisions are interpreted, documented and defended.
From Explainability to Operational Control
Embedding explainability into the workflow, however, is only part of the solution. To be effective, it must be applied consistently, at scale and in real time.
This is where AI-driven capabilities are increasingly playing a role.
For example, AI-powered assistants can embed these capabilities directly into analyst workflows, providing contextual explanations and guiding investigation steps in real time.
In practice, this means analysts can interact with alerts using natural language, asking questions such as:
- What other communication channels were referenced beyond WhatsApp?
- Who was the trader involved in this conversation?
- What transaction or position was being discussed?
They can then ask follow-on questions to build a clearer picture:
- When was the deal expected to occur?
- Who were the participants in the conversation?
- What historical activity or prior context is relevant?
As insights are gathered, analysts can move seamlessly from understanding to action, documenting findings, adding notes and progressing the case with greater speed and consistency.
But AI alone does not establish control.
Quality assurance serves a distinct and essential role. It evaluates decisions after they are made, identifying inconsistencies, assessing accuracy and feeding insights back into the system.
Together, these capabilities operate across the decision lifecycle:
- AI-supported explainability improves decision-making in real time
- Quality assurance strengthens decision quality over time
Both are required to move from explainability as a feature to explainability as a controlled, defensible process.
The Cost of Opacity
Regulators are no longer asking what your systems found. They are asking how your systems think.
In enforcement actions, firms are not only challenged on missed detection, but on their ability to explain how decisions were made, how models performed and how issues were identified and addressed.
The risk is no longer just failure to detect. It is failure to defend. Because if you cannot explain a decision, you cannot defend it.

By now, two pillars are clear: you must prove your data is complete, and you must be able to explain how your systems make decisions.
But one final test remains. Can your program operate consistently, at scale, every day; and can you prove it?
Because regulatory certainty is not just about visibility or explainability. It’s about sustained, repeatable performance.
