Regulatory Certainty Starts with Data Observability & Completeness
There is a question that has quietly moved to the center of regulatory scrutiny. It rarely appears at the beginning of a conversation, but it ultimately defines how that conversation ends.
What Did You Miss?
For years, compliance programs were evaluated based on their ability to detect misconduct. If an issue occurred and your systems identified it, that was taken as evidence the program was functioning as intended. Surveillance was outcome-driven, and those outcomes (alerts generated, cases escalated) were largely accepted at face value.
That framing no longer holds.
Today, regulators are less interested in what your systems found, and far more interested in what they might have failed to see — and whether you can prove that nothing material was missed. The burden has shifted from detection to demonstrable coverage, from confidence to evidence.
This is the foundation of regulatory certainty. And it begins in a place many organizations still underestimate: the integrity, completeness and observability of their data.
The Illusion of Completeness
Most firms believe they have their data covered. They can point to capture systems across voice, email, chat and trading platforms. They maintain archives. On paper, the environment appears comprehensive.
But regulatory scrutiny does not operate on architecture diagrams. It operates in operational reality.
In practice, data flows across a network of interdependent systems (front-office platforms, capture technologies, ingestion pipelines, enrichment layers, archives and surveillance engines). These systems are often implemented over time, across different business lines and jurisdictions, and are rarely as seamless as they appear.
As data moves through this ecosystem, failures do not always present themselves clearly. Instead, they manifest as subtle inconsistencies:
- A feed that delivers most (but not all) expected records
- A delay that pushes data outside downstream processing windows
- A mapping issue that misattributes activity to the wrong entity
- A communication channel that is technically captured but not fully normalized or surveilled
Individually, these issues may appear minor. Collectively, they create uncertainty about whether coverage is actually complete.
That uncertainty becomes critical when firms are asked to move beyond general assurances and answer precise, evidence-based questions:
- Do you maintain a complete and continuously updated inventory of all regulated communication and trading channels?
- Can you reconcile front-office systems to your archive to prove that no data was missed?
- If data fails to ingest or a feed drops, how quickly is that detected, and how is it escalated?
The issue is not whether firms have data. It is whether they can prove they have all the data they are supposed to have.
From Data Capture to Data Accountability
Historically, compliance infrastructure has been built around capture and retention. The objective was to ensure that communications and transactions were recorded and stored in accordance with regulatory requirements.
That is now baseline.
The expectation has evolved toward data accountability: the ability to demonstrate control over how data moves, transforms and behaves across its entire lifecycle.
This means being able to follow a piece of data from its origin (a trade, a voice call, a message) through ingestion, enrichment, archiving and ultimately into surveillance and reporting.
And critically, it means being able to prove that journey.
In more mature environments, this is supported by capabilities such as:
- Continuous reconciliation between source systems and downstream archives
- Automated detection and escalation of ingestion failures or volume anomalies
- End-to-end traceability of records across systems
- Immutable, auditable storage (e.g., WORM-enforced archives)
Individually, these are not new concepts. What is new is the expectation that they operate continuously, cohesively and transparently.
Why Regulators are Focusing Here
The increasing regulatory focus on data observability reflects a simple principle. Every control in a compliance program is only as strong as the data it relies on.
If data is incomplete, misaligned or unverifiable, then everything built on top of it (for example, models, alerts and investigations) becomes inherently uncertain.
This is why recent enforcement actions have increasingly highlighted failures not just in detection, but in data coverage and integrity. In some cases, firms failed to capture entire communication channels. In others, data was captured but not properly ingested or linked into surveillance systems.
The issue was not absence of technology. It was absence of visibility and control.
Regulators don’t expect perfection. But they do expect that firms can demonstrate:
- Where gaps exist
- What impact those gaps may have
- How quickly they can be detected
- And how they are resolved
That is what transforms a data issue into a controlled risk.
The Risk of Silent Failure
The most significant risk in this space is not visible failure. It is silent degradation.
A system continues to run. Alerts are still generated. Nothing appears broken. But somewhere upstream, coverage has eroded.
A feed becomes incomplete. A process fails intermittently. A portion of data is no longer being analyzed.
Because these issues don’t disrupt operations, they often go unnoticed — and can persist over time.
In this context, absence is a signal. A drop in activity, a dormant detection scenario or a gap between expected and actual volumes may not indicate lower risk, but a loss of coverage.
Without observability, these signals remain hidden. With observability, they become actionable.
From Completeness to Confidence
No firm has perfect data coverage, and regulators understand that.
What they expect is something more demanding: that firms understand their gaps, measure them and actively manage them.
A defensible compliance program doesn’t claim perfection. It does, however, demonstrate, clearly and consistently:
- What data should exist
- What data actually exists
- Where gaps or discrepancies occur
- And what actions were taken to address them
This is what transforms compliance from a system of assumptions into a system of evidence.
